Report Anti-Social Behaviour

When reporting anti-social behaviour please give as much information as possible such as date, time, location and names of persons involved if known. You should only take this action if you feel it is safe and appropriate to do so.Once you have spoken to the neighbour, allow a reasonable time before doing anything more, to see if there is any improvement. <h2 id="isPasted">What happens once you have reported anti-social behaviour</h2><ul id="isPasted"><li>Our Anti-Social Behaviour team will acknowledge your report and where appropriate give you advice on how to sort the problem out.</li><li>Some problems can be resolved easily but if the anti-social behaviour is more serious we will need to arrange an interview to talk to you in more detail before we start a full investigation.</li><li>At the initial interview an account of what has happened so far will be taken to help us decide on the most appropriate action.</li><li>In very serious cases we will make contact with you within 1 working day.</li><li>In all other cases we aim to hold this interview within&nbsp;4 working days of you making your complaint.</li><li>During the interview, we will assess the type of problem you are experiencing and possible solutions will be discussed with you.</li><li>At the end of the interview we will agree an action plan with you, setting out what will happen next.</li><li>This will usually include gathering further evidence and contacting other witnesses or agencies.</li><li>In some cases we may ask you to keep a log of any further incidents in an incident diary.</li><li>If for any reason you are unable to complete diaries, alternative methods of collecting information can be considered.</li><li>With your permission we may refer you to a mediation agency that can help resolve conflict between neighbours concerning excessive noise, children, &nbsp;parking disputes, barking dogs and parties.&nbsp;</li><li>We may also refer you to Basildon Council&#39;s <a class="fr-green" href="https://www.basildon.gov.uk/evh">Environmental Health Services</a> who can help deal with more serious noise nuisance or dog problems.</li><li>We will treat any information you give us as confidential and will not use it without your consent.</li><li>We will ask your permission before we contact the person you are complaining about.</li><li>[Basildon Council] will consider all the options available when investigating and taking action in a case of anti-social behaviour.&nbsp;</li><li>The actions, which include fast track responses in serious cases, are increasing, with the emphasis being on bringing about real changes in the behaviour of those who cause anti-social behaviour.</li><li>We have a range of <a class="fr-green" href="https://www.basildon.gov.uk/article/3666/Our-powers-to-tackle-ASB">powers to tackle anti-social behaviour</a> and we will take action against anyone who is committing anti-social behaviour regardless of whether they are a tenant or not (with the exception of action against the tenancy).</li></ul>

<h2 id="isPasted">Essex Restorative and Mediation Service</h2>In some circumstances, we may recommend using the Essex Restorative and Mediation Service. The service provides individuals harmed by crime, conflict, or antisocial behaviour an opportunity to communicate with the person responsible, and aims to find positive, mutually agreed outcomes for all.It is a voluntary process and both sides must agree for contact to take place. PSPO Consultation

The Council would like your views on the the current Public Spaces Protection Order (PSPO) which prohibits various types of anti-social behaviour and proposed variations to the Order.&nbsp; Residents are being invited to feedback on the Public Spaces Protection Order (PSPO) covering specific Restricted Areas within the Borough to tackle Anti-Social Behaviour (ASB) concerning alcohol and substance use, urination and defecation, use of motor vehicles, pony and traps and car cruising. Residents will also be asked questions about the proposed variations to the Order. Who do we want to hear from? This consultation is open to anyone who lives, works, visits, represents local communities, has a business or owns land within the borough. We are also keen to hear from partners and stakeholders who may be impacted by the order. Proposed variations - Bicycles

Bicycles - The Council is proposing to impose a Borough-wide prohibition to tackle the anti-social use of bicycles in public spaces as there is evidence to suggest this type of ASB is negatively impact on residents and their feelings of safety.We are not trying to discourage the use of bicycles, as this is a healthy activity, however some restrictions may be required to manage ASB such as riding in large groups, wheelies, riding close to pedestrians, and riding without consideration to traffic.&nbsp;

Proposed variations – Amplifiers 

The Council is proposing to impose a prohibition in Basildon Town Centre to tackle the anti-social use of amplifiers as there is evidence to suggest this type of ASB and the associated noise nuisance negatively impacts on residents, visitors, and businesses.&nbsp;We are not trying to discourage the expression of arts within the borough, and the prohibition will not affect planned events, however restrictions may need to be in place to manage noise nuisance being experienced.&nbsp;

Proposed variations – Illegal use of motor vehicles to include e-bikes and Basildon Town Centre

The Council is proposing to impose the existing illegal use of motor vehicles prohibition in Basildon Town Centre to tackle the anti-social use of motor vehicles as there is evidence to suggest this type of ASB negatively impacts on residents, visitors, and businesses.&nbsp;The Council is also proposing to include e-bikes within the existing prohibition.&nbsp;

Existing PSPO and Community Safety Warden Scheme 

This section is about getting your feedback on the effectiveness of the PSPO in general and the enforcement activity that is being delivered alongside this, including the deployment of the Community Safety Wardens.&nbsp;Your feedback will help to review and shape the PSPO and the Community Safety Warden service and ensure it remains fit for purpose.&nbsp;

<header id="isPasted"><h1 tabindex="0">Frequently asked questions</h1></header>Following public consultation, Basildon Borough Council has approved the implementation of a borough-wide Public Spaces Protection Order (PSPO) to tackle Anti-Social Behaviour (ASB).The PSPO will prohibit&nbsp;ASB concerning alcohol and substance use, urination and defecation, use of motor vehicles, pony and traps, and car cruising. The PSPO has been designed to ensure you can use and enjoy public spaces without experiencing ASB&nbsp;associated with the above.The PSPO will be in force from 1&nbsp;April 2022 until midnight on 31&nbsp;March 2025 and will provide additional powers to authorised officers to enforce the prohibitions within the order, supporting our partners in tackling these issues, to make the borough a safer place for all.When implementing the PSPO it was agreed to undertake an annual review to ensure it remained fit for purpose.
